TERMS AND CONDITIONS OF PURCHASE

KARTING IS AN INHERENTLY DANGEROUS ACTIVITY WHICH MAY CAUSE SERIOUS INJURY OR DEATH. PARTICIPATE AT YOUR OWN RISK.

By making this booking, you agree to the below and above terms and conditions of purchase, irrespective of what may have been required of you on previous visits to Hyper Karting. If you find our booking platform to be confusing, please reach out to us for clarification before booking. Please ensure that all booking details are correct when finalising your purchase. Please note that by making a booking over the phone, you agree to the Terms & Conditions outlined in this document.

1. AUTOMATIC SPEED CONTROL

 

YOUR KART SPEED ON TRACK IS DEPENDENT ON YOUR LAP TIMES - THE FASTER YOUR LAP, THE FASTER YOUR KART WILL GO.

We use an Automatic Speed Control System at Hyper Karting, meaning, you are in complete control of the speed of your kart. Each kart will start the race at 50% power*. It is then up to you to set lap times faster than the thresholds below to be granted a higher speed. This is measured on a sector-by-sector basis, so if you’re below the threshold for any given sector in a lap, your kart power will be increased appropriately.

2. DIFFERENCE BETWEEN EXPERT & STANDARD RACES

 

Expert Race:

To be eligible to race in an Expert Race, you must:

1. Have raced at Hyper Karting before;

2. Completed a lap time of less than 47 seconds; and

3. Not impede faster karts when on track.

 

If you have not achieved both of the above requirements, please book into a Standard race.

The Expert Race option is for experienced drivers looking to complete laps alongside other experienced drivers who are less likely to impede them. Kart performance levels will be determined in the same way as in a Standard Race, as outlined in the 'Automatic Speed Control' segment. You should only book into this race if ALL of your group are Expert drivers. A lap time below 47 seconds must be attained for you to race in an Expert Race. If you book into the Expert Race without having raced at Hyper Karting previously or having not attained sub-47 second laps, you will not be allowed onto the track and no refund will be provided.

Drivers in Expert Races who significantly prevent faster karts from completing unimpeded laps will be removed from the race and will not be entitled to any form of compensation. Whether or not a driver is significantly impeding faster karts will be at the sole discretion of staff.

 

Standard Race:

The Standard Race option is for those participants who are looking for a casual & fun race. This is great for those who aren't very experienced drivers or those who aren't out to set unimpeded lap times. Kart performance levels will be determined in the same way as in an Expert Race: based on the Automatic Speed Control system. Due to the nature of indoor go-karting, this race type may require more overtaking and stoppages than the Expert Race category.

3. FAMILY GROUPS

If you would like to race as a family (i.e. with someone from your group being under 16), you may only book into a race appropriate for the youngest racer. Please note that adults (Ages 16+) racing in lower age groups will not exceed a speed of 50% of the kart's performance, regardless of capability and previous experience. This is to ensure the safety of all drivers.

We highly recommend that you race in your appropriate age category to ensure the best possible experience.

4. RACE TIME & EXPERIENCE LENGTH

Please arrive at least 10 minutes prior to your race time to allow sufficient time to complete the race registration. The race briefing & helmet fitting will begin at your scheduled race time with your race starting approximately 15 minutes later. Each race lasts for approximately 15 minutes.

Your total experience, if you were to book 1 race, should last 35-40 minutes (including arrival and departure). However, this can vary.

5. COVID-19

Hyper Karting has taken numerous steps to promote the safety of both staff and customers in light of the recent surge in COVID-19 cases, as outlined below:

• Staff & customers are encouraged to wear face masks in the venue at all times, including underneath helmets;

• Karts are regularly sanitised, including disinfection of the steering wheel, seat & any surfaces that previous customers may have touched. Each kart also usually has a minimum of 15 minutes between uses (although this is usually longer);

• Helmets are usually sanitised, sprayed & wiped down after every use. We recommend all customers who have their own full-face helmet to use this instead of the ones available at Hyper Karting. Hairnets are also required to be worn at all times; and

• Hand Sanitiser is provided throughout the venue.

OUTDOOR BUSINESS FOR COVID CLASSIFICATION

Hyper Karting is an outdoor venue, located on Level 5 of an open-air car park. There is an extremely high level of airflow/ventilation in the venue and a significantly reduced risk of transmission compared to indoor venues.

6. VARIABLE PRICING ON WEBSITE

Our prices vary depending on the day of the week/time of day and range from $19 to $59 per person, per race. The price mirrors our busy/quiet periods (ie. busy periods are more expensive and vice versa for quiet periods). For our most affordable races, look to come in the early morning, late in the evening, or days earlier in the week!

Upon selection of your desired race time, the price is displayed at the top of the page. The system auto-selects the first race of the day (TIME NOT YET SELECTED). To see the price of the individual time slot that you are after, please select the time and see the varied price at the top of the page.

Please note that the price of a given session can also vary as time passes, particularly in the hours immediately before the session.

 

7. RACE REGISTRATION

All participants must register for their race using the following link prior to arriving at Hyper Karting:

8. RACE REQUIREMENTS (AGE, HEIGHT & WEIGHT)

• Minimum Height - 140cm

• Maximum Weight - 130kgs

• Correct age for the age category that has been booked

• Correct ability for the race type that has been booked

• Enclosed footwear

• No loose clothing is allowed on the track

• Participants must not be under the influence of alcohol or drugs

Race Registration must be completed prior to your race briefing

• Drivers must not be a danger to themselves or others

• All drivers must wear a full-face helmet which meets Australian or European motorbike helmet standards and a hairnet

The person making this booking agrees to all the Terms and Conditions outlined on behalf of themselves, and on the behalf of all other participants for which they are booking.

 

9. DANGEROUS DRIVING & DRUGS / ALCOHOL POLICY

We have a zero tolerance policy towards dangerous driving. All participants must ensure that they are not a risk to themselves, other participants, staff, or our equipment. Drivers who are making contact with the barriers/other karts, or are otherwise driving dangerously (at the complete discretion of staff) may not be able to race or may be removed from the race. If a participant is removed from a race, they will not be entitled to a refund, reschedule, credit or exchange for that race or for future races they may have also booked in for.

Further, if a patron is found to be intoxicated, or under the influence of alcohol or drugs, they will not be allowed to race, in any circumstance. Hyper Karting reserves the right to breathalyse customers upon arrival, and refuse any patron/s at staff discretion. No form of compensation, including refunds or gift cards, will be provided.

10. SPEED CONTROL

While the individual speed of karts is set by the Automatic Speed Control, races in the 12-15 & Under 12 age categories will be set at an initial speed suitable for the skill level of all individuals on the track. From this starting point, individual racers will be sped up according to their ability and confidence. The top speed of all ages will depend on your own ability, and could be as high as 50km/hr. Regardless of age, kart speeds are adjusted to match the ability of ALL drivers on the track.

11. MULTIPLE RACES & BACK-TO-BACK RACES

For those looking to book multiple races, we recommend leaving a gap between your sessions, instead of booking them back-to-back, to ensure adequate time for rest. If you book back-to-back sessions, we may require you to remain seated in your kart between races.

 

12. REFUND POLICY

Hyper Karting reserves its right that bookings are strictly non-refundable regardless of the reason for non-attendance, unless ‘Booking Protection’ has been added in the checkout process. For bookings greater than or equal to 30 seats total, a minimum rescheduling notice of one (1) week is required, in which case a gift card will be issued to the total amount of your booking value. For bookings with less than 30 seats, a minimum rescheduling notice of 48 hours is required, in which case a gift card will be issued to the total amount of your booking value. Rescheduling notice must be provided to pitcrew@hyperkarting.com.au or via phone on (02) 8311 4124.

No refund will be provided for issues arising from:

• Racers below 140cm as determined by staff;

• Racers above 130kgs;

• Racers who are not the correct age for their race category;

• Racers who are not the correct ability for the race type that has been booked (Standard v. Expert);

• Racers with a non-zero blood alcohol content (BAC) level or who are suspected by staff to be under the influence of drugs;

• Racers who staff deem to be a hazard to themselves or others;

• Racers who are involved in a race where there has been an accident which has caused themselves or others injury, or has meant that their time on track or at full speed was reduced. This applies regardless of who is at fault;

• Racers who instigate, or are involved in, any misconduct, harassment, or abusive behaviour towards staff members, as deemed unacceptable at the discretion of Hyper Karting Staff; and

• Being late as a result of events in the Entertainment Quarter, Hordern Pavillion or SCG / SFS.

 

Although we endeavour to ensure your time at Hyper Karting is as enjoyable as possible, there may be periods where the technology system used is malfunctioning (e.g. kart's steering wheel display screens and/or lap times), or where our team are running late for a variety of reasons. No form of compensation or refund will be provided to customers who are inconvenienced or incur costs due to any delays, including but not limited to the cost of parking. The time selected for your booking represents the time that you should arrive.

BOOKING PROTECTION

 

If you have selected Hyper Karting ‘Booking Protection’ upon checkout and paid for it in your order, you may be eligible for a 100% refund if you cannot attend for one of the many reasons in our Booking Protection Terms and Conditions.

 

If you would like to submit a refund request and initially paid for booking protection, please click here and you will be redirected to a refund application form. Please note proof is required for all refund requests, outlined in the T&C’s above.

 

Booking Protect is an optional extension to our standard Terms & Conditions of sale and trade, and it provides a refund for certain defined circumstances outlined in the ‘Booking Protection Terms & Conditions’.

 

COVID Refund Policy:

Bookings cannot be refunded unless proceeding with the booking would put you or other members of your group DIRECTLY in breach of NSW Government Health requirements, in which case, refunds to gift cards will be made at the discretion of staff after investigation and consideration of the circumstances. The entirety of a group’s booking will also not be refunded if one or more members of the group are unable to make the booking for ‘COVID reasons’.

 

Reasons for non-attendance that existed PRIOR to a booking being made or have existed for a significant amount of time before a request for cancellation is made will not be considered when determining whether a store credit is appropriate. Such reasons include (but are not limited to):

• Significantly increased COVID case numbers (either in Sydney or elsewhere);

• Government imposed restrictions or recommendations; and

• Restrictions on participants such as the need to self-isolate as a result of being a close contact, a casual contact, being symptomatic of COVID or awaiting test results.

As such we encourage purchasers to reach out to us as soon as possible when circumstances arise that may prevent them from participating.

13. DAMAGE TO KARTS, EQUIPMENT AND PREMISES

Visitors to Hyper Karting will be required to pay reasonable amounts for any damage that they cause to karts, equipment, barriers, or the premises. This includes a $100 helmet purchase fee if a participant is sick and vomits into a helmet.

14. CANCELLATION POLICY

Hyper Karting reserves the right to cancel and fully refund customers at Hyper Karting's discretion. Reasons for refunding may include changing Government health advice as to the way Hyper Karting is allowed to operate.

16. GRIP DRIP

The track may be gripped up with our special 'Grip Drip' formula at certain times of the day. These times can vary and are specified for certain on this linked page here. These times are usually every day:

• Before the first race of the day; and

• At 9:00pm (immediately before the 8:45pm Expert Race)

On average, this reduces lap times by about 5-10% These sessions are the best way for you to get bragging rights over your mates or try and beat your best time!
