Hyper Karting Privacy Policy

Hyper Karting Pty Ltd (“Hyper Karting”, “we”, “us”) operates the Hyper Karting venue at the Entertainment Quarter, Moore Park, along with BattleKart and Pixel. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (“APPs”).
This policy covers our website at hyperkarting.com.au, the Hyper Karting mobile app, driver registration and race results, bookings and payments, and our venue itself. By using them you agree to this policy.
1. What we collect
- Contact and account details — your name, email address, phone number, and postal address if you give it to us.
- Driver registration — your date of birth, address and postcode, gender, and your signature on our terms and risk acknowledgement. Where the driver is a child, we also collect the name and date of birth of the parent or guardian who signs for them.
- Bookings and payments — what you booked, when, for how many drivers, and the order record. Card payments are processed by Shopify’s hosted checkout, so we never receive or store your card number.
- Racing data — your driver profile and identifier in our timing system, your lap and sector times, finishing positions, the karts and track layouts you drove, your personal bests, your driver rating, and your visit and race counts. Also your store credit balance, your membership status, and any Rivals connections you make in the app.
- Marketing preferences — whether you opted in to email, SMS or both, and when that changed — and anything you send us, including enquiries, survey responses, careers applications and incident reports.
- Website and app usage — your browser and device type, IP address, the pages and products you view, and how you reached us, collected with cookies and server logs (see section 8). The app also stores your email address, first name, account identifier, chosen venue and sign-in session on your device. If you enter a postcode for local-resident pricing we keep it for 12 months — the app matches it against a list built into the app, and does not use GPS or any device location service.
- Crash reports — if the app fails, a diagnostic report goes to our error monitoring provider so we can fix the fault. These reports are configured to exclude personal information and are not linked to your account.
2. How we use it
To take and fulfil your booking and send you confirmations, reminders and receipts; to register you as a driver, confirm you are eligible for the track you booked, and check you in; to record your lap times and show you your results, statistics and rating; to run store credit, gift cards, membership and promotions including local-resident pricing; to run Rivals at your request; to provide customer service and handle refunds; to keep the venue safe, investigate incidents and meet our insurance and work health and safety obligations; to detect fraud and protect our systems; to send you marketing where you have opted in; to improve our website and app and measure our advertising; and to comply with the law.
3. Who we share it with
We do not sell your personal information. We share it with service providers who help us run the business, and they may only use it for the purpose we engaged them for: Shopify, which powers our online store, checkout and customer accounts (read the Shopify privacy policy); RaceFacer, our race timing and driver registration system, which holds your driver profile and your results; and providers of email and SMS messaging, hosting and databases, error monitoring, customer surveys and website analytics.
We also disclose personal information to professional advisers, insurers and auditors where reasonably necessary; where required or authorised by law, including in response to a subpoena or warrant, or to protect our rights or someone’s safety; and to a buyer if our business or its assets are sold, who may continue to use it as set out in this policy.
Overseas. Our main customer database and hosting are configured for Australia, but some of the providers above store or process information overseas. By using our services you consent to your personal information being disclosed to recipients in the United States, Canada and the European Union. We take reasonable steps to ensure it is handled consistently with the APPs, but we may not be able to control the privacy practices of an overseas recipient.
4. Race results are visible to other people
Karting is a competitive sport and results are shared, so please read this before you race.
- On the timing screens at the venue, your first and last name appear next to your lap times, visible to everyone on the floor.
- On a race results page, the results of a session — including the first and last names of every driver in it — can be viewed by anyone with the link.
- In the app, when you open a heat you raced in, you see the other drivers’ names and they see yours. On leaderboards, other drivers are shown only by first name and last initial.

5. Children and junior drivers
We have junior and mini circuits designed for children. Our website and app are not intended for children under 13, and anyone under 18 should use them with a parent or guardian’s permission — bookings and accounts must be made by an adult. A parent or guardian must register a junior driver, provide the child’s name and date of birth, and sign our terms and risk acknowledgement on their behalf. We do not send marketing to children; it goes to the adult who consented. A junior driver’s name and lap times appear on the venue screens and results pages described in section 4, the same as any other driver, and a parent or guardian can ask us to access, correct or delete their child’s information at any time using the details in section 9.
6. Marketing and how to opt out
We send marketing by email and SMS only where you have opted in, and we keep a record of that consent. To stop it: use the unsubscribe link in any marketing email, or visit our unsubscribe page; reply STOP to any marketing SMS; or email hello@hyperkarting.com.au and we will action it for you. Opting out does not stop service messages you need, such as booking confirmations, reminders for a session you have paid for, refund notices and safety information.
We also use your information to show you advertising we think will interest you. You can opt out of targeted advertising with the advertising platforms directly, or through the Digital Advertising Alliance opt-out portal.
7. Access, correction and deletion
You may ask for a copy of the personal information we hold about you, ask us to correct it if it is wrong or out of date, or ask us to delete it. Email hello@hyperkarting.com.au and we will respond within 30 days. We may need to verify your identity first, and in limited cases the Privacy Act allows us to refuse a request — if we do, we will tell you why in writing. You can also see and update much of your information yourself, in your account on our website or on the Account tab in the app.
Deleting your account. You can delete your Hyper Karting account at any time: in the app, on the Account tab, or by emailing hello@hyperkarting.com.au. We sign you out of every device immediately, and your personal details are removed within 30 days of your request.
We keep your booking, order and payment records, because we are required to retain business and tax records — the transaction stays on file after your name is removed from it. We also keep your lap times as venue timing records, because removing them would leave gaps in other drivers’ results, but we replace your name with a neutral placeholder so they are no longer identified as yours.
Also note that any remaining store credit is forfeited and cannot be restored; that your name comes off any upcoming booking, so bring your confirmation email to check in; that deleting your account does not cancel a membership billed as a recurring charge, which you must cancel separately; that deletion cannot be undone, and signing in again later with the same email address gives you a new, empty account; and that RaceFacer holds a separate driver profile subject to its own retention practices.
8. Cookies, security, and how long we keep things
We use cookies and similar technologies on our website to keep your cart and session working, remember your preferences, understand how the site is used, and measure our advertising. You can block or delete cookies in your browser settings, though parts of the site may stop working. We use Google Analytics to understand how the site is used — you can opt out.
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure, including encrypted connections, access controls limiting staff to what their role requires, and using reputable providers. No method of transmission or storage is completely secure. If a data breach occurs that is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.
We keep personal information only as long as we need it, or as long as the law requires. Driver registration and waiver records are kept to meet our safety, insurance and legal obligations; booking, order and payment records as business and tax records; race results as venue timing records. A postcode entered in the app is discarded after 12 months, and sign-in session data is cleared when you sign out. Where we no longer need information and are not required to keep it, we destroy it or de-identify it.

We will acknowledge your complaint promptly and aim to resolve it within 30 days, and will tell you the outcome in writing. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au, on 1300 363 992, or at GPO Box 5218, Sydney NSW 2001.
We may update this policy from time to time to reflect changes in our practices or for operational, legal or regulatory reasons. The current version is always at hyperkarting.com.au/pages/privacy-policy, and the “last updated” date tells you when it last changed. Where a change is significant we will take reasonable steps to notify you.
